State v. Cage

Opinion of the Court

In re Donald Cage, applying for Reconsideration of Denial Writ of March 9, 1984, 446 So.2d 1214, to the Court of Appeal, First Circuit, Number 83-KA-0828; Nineteenth Judicial District Court, Parish of East Baton Rouge, Number 5-81-963.

Reconsideration denied.

DIXON, C.J., and CALOGÉRO, J., would grant the writ.

Concurring Opinion

LEMMON, J.,

concurs in the denial. However, I would be willing to consider in the appropriate case the question of whether the state is required to notify the defendant prior to trial that he will be subject to a mandatory additional two-year sentence if the evidence adduced at trial establishes that a firearm was used in the commission of the felony.
