concurs. The trial judge has not yet ruled on the motion for summary judgment and in the district court defendant may supplement his motion for summary judgment with affidavit in support.

MARCUS, WATSON and LEMMON, JJ.,

would grant and remand to [the] Court of Appeal for a ruling on the issue of summary judgment.
