DIXON, C.J.,

agrees that the writ should be denied. Although probable error is shown in the application, it is not of constitutional proportions (as required for post-conviction relief).

CALOGERO, J., would grant the writ. LEMMON, J., would grant the writ as to Assignment of Error number VII.
