Granted. The judgment of the Court of Appeal is reversed and the trial court order is reinstated. See Pioneer Bank & Trust Co. v. Oechsner, 468 So.2d 1164 (La. 1985).

CALOGERO and DENNIS, JJ., would grant the writ. LEMMON, J., dissents.
