Dissenting Opinion

DIXON, C.J.,

is of the opinion that the writ should be granted. The law places the burden on the state to prove the confession was not illegally induced. The officer who is alleged to have induced the confession was not called.

CALOGERO, J., would grant the writ. DENNIS, J., would grant and remand for absent officer’s testimony.
