Supreme Court of Louisiana
In re Grand Jury Investigation Relative to the Finances & Budget of Baton Rouge, 477 So. 2d 693 (La. 1985)
1985 La. LEXIS 10050
Calogero, Dixon, Grant, Lemmon, Watson, Writ
In re Grand Jury Investigation Relative to the Finances & Budget of Baton Rouge
Opinion of the Court
In re: State of Louisiana; Applying for SUPERVISORY WRIT; to the Court of Appeal, First Circuit, Number CW/85/1349; Parish of East Baton Rouge 19th Judicial District Court Div. “A” Number NONE.
DENIED.
Concurring Opinion
concurs and agrees with the denial of this writ. The Court of Appeal was correct in remanding the motion to recuse the judge to the district court for the District Attorney to amend his motion and allege facts which show bias on the part of the judge which would disqualify the judge from trying the motion to recuse or remove the District Attorney.
