IN RE: Alexandria Anesthesia Service; Hyatt, William Rodney; Applying for Reconsideration of Writ Denial on November 15, 1985, 478 So.2d 146, Parish of Rapides 9th Judicial District Court, Div “C” Number 127, 918; to the Court of Appeal, Third Circuit, No. 85-809.

Rehearing granted. The Court of Appeal judgment is reversed. The appeal is reinstated. The case is remanded to the Court of Appeal for further proceedings.

Concurring Opinion

CALOGERO, J.,

concurs. At the least the Court of Appeal should construe rela-tors’ appeal, timely or not, as an application for writs to review the ruling overruling the exception of prematurity.
