CALOGERO and DENNIS, JJ.,

concur in the majority’s action. Applicant makes no showing that he will be prejudiced by having to amend his petition. Should he be deprived of adequate procedural remedy by our ruling he may reapply for supervisory writs.

DIXON, C.J., would grant the writ.
