Cromwell v. Commerce & Energy Bank of Lafayette

Cromwell v. Commerce & Energy Bank of Lafayette
Supreme Court of Louisiana · Decided February 21, 1986 · Dennis
483 So. 2d 592; 1986 La. LEXIS 8167 (Southern Reporter, Second Series)

Cromwell v. Commerce & Energy Bank of Lafayette

Opinion of the Court

DENNIS, Justice,

concurring.

I respectfully concur.

The majority opinion, 464 So.2d 721, reaches the correct conclusion but goes far beyond what is necessary to decide this case. There was clearly no fraud even under an expansive view of “fraud in the transaction.” In dicta, the majority opinion reaches issues which should be treated more fully and separately in future cases. For these reasons, I respectfully concur.
