LEMMON, J.,

concurs. The ruling of the Court of Appeal is correct. See Speeg v. Stewart Title Guaranty Co., 377 So.2d 589 (La.App. 4th Cir. 1979), on original hearing, and 381 So.2d 582 (La.App. 4th Cir. 1980) (Redmann and Lemmon, JJ., dissenting).
