500 So. 2d 410; 1987 La. LEXIS 8301 (Southern Reporter, Second Series)
Kember v. Louisiana House of Representatives

Opinion of the Court

In re: La. House of Representatives, John A. Alario, Jr., Speaker, applying for Reconsideration of Order of Dismissal of Appeal dated January 9, 1987, to the 19th Judicial District Court, Parish of East Baton Rouge, No. 309,373.

Reconsideration denied.

Concurring Opinion

CALOGERO, J.,

concurs, being of the view that the judgment of the district court declaring the statute unconstitutional has no force and effect, except as between the parties, because the appeal in this case has been dismissed simply because moot.

Concurring Opinion

DENNIS, J.,

concurs believing that it is the intent and effect of the majority’s judgment that the trial court’s judgment has been rendered moot and of no legal effect by appellee’s resignation from the Legislature.
