Concurring Opinion

LEMMON, J.,

concurs. La.C.C.P. art. 82 is a venue article which determines the proper parish for the suit if the State of Louisiana has jurisdiction. The appropriate jurisdiction to be considered is jurisdiction in rem under La.C.C.P. art. 8 which confers jurisdiction if the property at issue has a situs in this state.

DIXON, C.J. and CALOGERO, J., would grant the writ.
