Dissenting Opinion

CALOGERO, J.,

expresses the additional observation the Court was advised after its action denying this writ that the district court has not yet acted on the identical application and that the Court should have been, but was not so advised by applicant’s attorney. I am of the view that the district court should still act on the application pending there, and that thereafter applicant is at liberty to file anew in this Court such pleading or renewal of application as he may choose to.
