Opinion of the Court

In re Delatte, Joseph V.; Applying for Writ of Certiorari and/or Review; to the Court of Appeal, First Circuit, Number KA86 1172; Parish of West Feliciana 20th Judicial District Court, Div. “A”, Number W85-8-1144.

Concurring Opinion

LEMMON, J.,

concurs. Transportation of livestock to a slaughterhouse or an auction sale barn and assignment in a record book in a name other than the owner’s does not constitute a presumption, but rather is a second method of committing the crime of theft of livestock.

CALOGERO and DENNIS, JJ., would grant the writ.
