Concurring Opinion

LEMMON, J.,

concurs. Transportation of livestock to a slaughterhouse or an auction sale barn and assignment in a record book in a name other than the owner’s does not constitute a presumption, but rather is a second method of committing the crime of theft of livestock.

CALOGERO and DENNIS, JJ., would grant the writ.
