PER CURIAM.

For the reasons assigned on rehearing in Toney v. Whitfield, 531 So.2d 445 (La. 1988), decided this date, the judgment of the district court is reversed and the case is remanded to the district court for proceedings consistent with our opinion therein.

concurs, disagreeing with the statement that the statute would be unconstitutional under another interpretation of the statute.
