State v. Wingert

Opinion of the Court

PER CURIAM.

Motion for clarification granted. At the new trial the prosecutor must establish a proper foundation for the admission of the videotape. Further, if the videotape contains inculpatory statements made by defendant during custodial interrogation, either the prosecutor must establish that defendant was advised of and waived his constitutional right to remain silent prior to interrogation or the pertinent video portion of the tape must be excluded.
