Concurring Opinion

LEMMON, J.,

concurs in the denial, but notes that Jones v. Thibodeaux, 445 So.2d 44 (La.App. 4th Cir. 1984), which was relied on by the Court of Appeal in this case, decided a different attack on the constitutionality of the statutory scheme.

DIXON, C.J., and CALOGERO and DENNIS, JJ., would grant the writ.
