LEMMON, Justice,

concurring.

The plaintiff's deposition has already been taken in the present case. Otherwise, I would grant the application to decide whether to defer, until after the defendant has had an opportunity to take the plaintiffs deposition, discovery of photographs and videotapes taken of plaintiff by the defendant for impeachment purposes.

MARCUS and COLE, JJ., concur for reasons assigned by LEMMON, J. CALOGERO, C.J., would grant the writ.
