Granted. Case remanded to the trial court to determine whether defendant waived his right to appeal. See State v. Counterman, 475 So.2d 336 (La. 1985).

CALOGERO, C.J., and DENNIS and WATSON, JJ., would grant an out of time appeal and remand for appointment of counsel.
