ORDER

After the United States Supreme Court’s decision in Foucha v. Louisiana, — U.S. -, 112 S.Ct. 1780, 118 L.Ed.2d 437 (1992), reversing the decision of this court, the district court on June 30, 1992 issued an order discharging the petitioner from custody. The state has not sought review of that ruling, and further proceedings in this case are now moot.
