Dissenting Opinion

CALOGERO, C.J., and MARCUS, J.,

would grant and remand to the hearing committee in order to give respondent an opportunity to present additional evidence to meet his burden of proof under Supreme Court Rule 19, Section 24E(4)(5)(6). The hearing committee should then issue a recommendation supported by written reasons and the parties may seek review in the disciplinary board and this Court as provided in the Rules.
