Denied. Result correct.

Concurring Opinion

LEMMON, J.,

concurs. Transit Management was not an indispensable party. Nevertheless, because the non-specific denial in the answer may have been misleading, the trial judge in her discretion could have granted a new trial, reopened the evidence, or (as she did) granted a mistrial.
