LEMMON, J.,

concurs, but notes that the denial of certiorari simply allows the case to proceed to trial on the merits, rather than reviewing the case on an exception of no cause of action, and does not necessarily indicate agreement with the decision of the court of appeal.

DENNIS and ORTIQUE, JJ., would grant the writ. MARCUS, J., not on panel.
