Opinion of the Court

PER CURIAM.

DENNIS and KIMBALL, JJ., dissent from the order. CALOGERO, C.J., not on panel.

Concurring Opinion

LEMMON, J.,

concurs. Because this court is reversing a summary judgment, the malpractice defendants will have the opportunity on remand to plead and prove proportionate fault on the part of Piccadily.
