Dissenting Opinion

CALOGERO, C.J.,

would grant and deny intervenor’s recovery against plaintiff-relator. The pleadings of the intervenor do not seek judgment against plaintiff, but rather unsuccessfully sought recovery from defendants out of such moneys- as plaintiff might recover in the litigation from defendants, an event that did not come about.

WATSON and WILLIAMS, JJ., would grant the writ. DENNIS, J., not on panel.
