Granted. Judgment of the court of appeal is reversed. Judgment of trial court granting a new trial is reinstated.

CALOGERO, C.J., LEMMON and HALL, JJ.,

would grant the writ and remand to the court of appeal for a full opinion explaining the reason for reversing the trial court.
