KIMBALL, J.,

concurs in the denial of the writ application, being of the belief that the Tangipahoa Parish Consolidated Drainage District Number One is not the proper party to seek relief either on behalf of the State of Louisiana or on behalf of the witness whose deposition is being sought.

JOHNSON, J., would grant the stay order and reschedule the deposition for no later than April 17, 1995. VICTORY, J., would grant the stay order. MARCUS, J., not on panel.
