Opinion of the Court

In re Transportation & Dev., Dept. of;— Plaintiffs); applying for supervisory and/or remedial writs; to the Court of Appeal, Fifth Circuit, No. 96-CW-0311; Parish of St. Charles, 29th Judicial District Court, Div. “E”, No. 34,524.

The ruling of the trial court denying a jury trial is reversed. The State’s (DOTD) right to a jury trial is reinstated. Otherwise denied.

WATSON, J., would deny the writ. WATSON, J., would grant the rehearing.
