ORDER

Consideration of this application was deferred pending the finality of Shell Oil Company, et al v. Secretary, Revenue and Taxation, 96-0929 (La. 11/25/96); 683 So.2d 1204. Now that Shell Oil has become final, we remand this ease to the First Circuit Court of Appeal for reconsideration in light of Shell Oil.
