Opinion of the Court

In re Winesberry, Wayne; — Defendant(s); Applying for Supervisory and/or Remedial Writs; Parish of Jefferson 24th Judicial District Court, Div. “B”, No. 951-129; to the Court of Appeal, Firfth Circuit, No. 97-KW-0848.

Stay denied. Writ denied.

CALOGERO, C.J., concurs in this Court’s action. KNOLL, J., not on panel.

Concurring Opinion

CALOGERO, Chief Justice,

concurring.

As I appreciate the issue involved as to which the court of appeal and this Court have denied writs, it has to do with the trail court’s ruling simply allowing the State to obtain additional chemical testing. What may develop at the time the result of that testing is offered through testimony or otherwise at trial remains to be seen — including what may develop by way of defense counsel’s request for its own opportunity to have the evidence tested.
