State ex rel. Jackson v. State

Opinion of the Court

In re Jackson, Timothy; — Plaintiff; Applying for Supervisory and/or Remedial Writ, Parish of Orleans, Criminal District Court Div. F, No. 881-279; to the Court of Appeal, Fourth Circuit, No. 98-K-1775

Denied. La.C.Cr.P. art. 930.3; State ex rel. Melinie v. State, 93-1380 (La.1/12/96), 665 So.2d 1172.

KIMBALL, J., not on panel.

Dissenting Opinion

JOHNSON, J.,

would grant the writ. This sentence is constitutionally excessive in that it is grossly out of proportion to the seriousness of the offense. See State v. Lobato, 603 So.2d 739 (La. 1992).
