State v. Simmons

State v. Simmons
Supreme Court of Louisiana · Decided April 20, 2000 · Calogero, Grant, Knoll, Lemmon, Writ
760 So. 2d 333; 2000 La. LEXIS 1236 (Southern Reporter, Second Series)

State v. Simmons

Opinion of the Court

In re Simmons, Kenneth; — Defendant; Applying for Writ of Certiorari and/or Review, Parish of Jefferson, 24th Judicial District Court Div. L, Nos. 95-1196; to the Court of Appeal, Fifth Circuit, No. 98-KA-841.

Denied.

KNOLL, J. not on panel. CALOGERO, C.J., would grant the writ.

Concurring Opinion

LEMMON, J.,

concurs in the denial because I believe, contrary to the determination by the court of appeal, that the trial judge did not err in denying relator’s motion for mistrial during the prosecutor’s closing argument. Moreover, if the denial had been reversible error, I further disagree that the error would have been harmless beyond a reasonable doubt.
