Concurring Opinion

LEMMON, J.,

concurs. Although defendant did not seek review in this Court of the portion of the ruling of the trial court unfavorable to him, that ruling is contrary to the subsequent decision of this Court in State v. Gomez, 2000-KK-0566 c/w 0677 (La.1/17/01), 778 So.2d 549. Because of this, defendant may wish to reassert the motion in this capital case.
