In re Applying for Supervisory and/or Remedial Writs, Parish of Iberville, 18th Judicial District Court, Div. C, No. 2141-96; to the Court of Appeal, First Circuit, No. 2001-KW-1035.

Writ Granted. The trial court erred in granting a mistrial sua sponte. The defendant’s subsequent motion was untimely and groundless. The mistrial is reversed and the case is remanded for further proceedings.

KIMBALL and KNOLL, JJ., would deny the writ.
