Dissenting Opinion

LOBRANO, J.,

would deny the writ as to liability and compensatory damages. As to punitive damages, contract claims and cross claims, would set aside the trial court’s ruling and remand for further consideration after trial on the merits in accordance with the reasoning of the Fourth Circuit.
