Opinion of the Court

In re Supple, Jeremiah;—Defendant; Applying for Supervisory and/or Remedial Writs, Parish of Lafayette, 15th Judicial District Court Div. D, No. 2001-2856; to *488the Court of Appeal, Third Circuit, No(s). CW 02-00776, CW 02-00847.

Stay recalled; writ denied.

CALOGERO, C.J., recused. KIMBALL, J., would grant.

Concurring in Part

KNOLL, J.,

would grant in part and deny in part. I find the court of appeal erred in reversing the trial court’s ruling finding no conflict of interest under Rule 1.9 of the Rules of Professional Conduct, and I would reverse the court of appeal’s ruling which disqualified the law firm of Durio, McGoffin, Stagg & Ackermann from representing Jeremiah Supple and reinstate the trial court’s ruling. In all other respects, I would deny relator’s writ application.
