Granted. Remand to Court of Appeal to reconsider in light of State v. Sylvia, 01-1406 (La.4/9/03), 845 So.2d 358, 2003 WL 1826668.

dissents from the Court’s action. The majority opinion in Sylvia, 01-1406 (La.4/9/03), 845 So.2d 358, 2003 WL 1826668 was wrong. But in all events, the case is distinguishable from Sylvia.
