Granted. The ruling of the Court of Appeal is reversed and this case is remanded to the First Circuit Court of Appeal to consider the merits of Lexington’s appeal. See Shell Pipeline Corp. v. Kennedy, 00-3027 (La.10/16/01), 799 So.2d 475.
