Concurring Opinion

WEIMER, J.,

concurs in the result. Miller v. Oubre, 96-2022 (La.10/15/96), 682 So.2d 231 establishes a precedent that plaintiffs could arguably rely on in urging that their application was filed timely. We should not decide whether the result in Miller is correct without affording plaintiffs an opportunity tó be heard. I concur in the résult, however, because I believe the Court of Appeal was correct in finding the matter is premature.’
