Forum for Equality PAC v. City of New Orleans

Supreme Court of Louisiana
Forum for Equality PAC v. City of New Orleans, 882 So. 2d 587 (La. 2004)
2004 La. LEXIS 2572; 2004 WL 2278607
Weimer

Forum for Equality PAC v. City of New Orleans

Concurring Opinion

WEIMER, J.,

concurs in the result. Miller v. Oubre, 96-2022 (La.10/15/96), 682 So.2d 231 establishes a precedent that plaintiffs could arguably rely on in urging that their application was filed timely. We should not decide whether the result in Miller is correct without affording plaintiffs an opportunity tó be heard. I concur in the résult, however, because I believe the Court of Appeal was correct in finding the matter is premature.’
