In re State of Louisiana; — Plaintiff; Applying for Writ of Certiorari and/or Review, Parish of Orleans, Criminal District Court Div. C, No. 387-335; to the Court of Appeal, Fourth Circuit, No. 2002-KA-1098.

The state did not seek timely review of the court of appeal’s decision in this Court. Accordingly, the state waived its right to review and the application is hereby denied. See State v. Matthews, 02-1121 La. 2/13/04, 868 So.2d 21.
