Concurring Opinion

JOHNSON, J.,

would grant the writ application. I would reverse the rulings of the court of appeal and the trial court and grant the defendant’s motion to suppress. While the police officer had probable cause for this investigatory stop, when it became clear that the driver of the vehicle and the passenger had no outstanding warrants, there was no probable cause for the search of the vehicle.
