Talbot v. Gill
Supreme Court of Louisiana · Decided July 17, 2007 · Calogero

Talbot v. Gill

Opinion of the Court

In re Talbot, Theresa; — Plaintiff; Applying for Supervisory and/or Remedial Writs, Parish of Jefferson, 24th Judicial District Court Div. A, No. 640-864; to the *894Court of Appeal, Fifth Circuit, No. 07-C-189.

Writ denied. Stay denied.

Concurring Opinion

CALOGERO, C.J.,

concurs in the denial of the writ application and assigns reasons. While the court of appeal may have properly vacated the district court’s judgment, I believe the court of appeal acted prematurely in opining that the language of the lease contemplates only a one-time renewal. The issue of the lease renewal is better left for a determination by the court hearing the eviction proceedings.
