Concurring Opinion

KIMBALL, J.,

concurs and assigns reasons. While I question the Hearing Officer’s application of La. R.S. 23:1318 to grant Plaintiffs motion to quash the subpoenas issued in connection with the motion to recuse hearing upon which this writ has been filed, I concur in denial because Defendant did not seek timely review of that ruling in this Court.
