Supreme Court of Louisiana
Beutler England Clinic v. Mermentau Rice, Inc., 963 So. 2d 383 (La. 2007)
2007 La. LEXIS 1883; 2007 WL 2697446
Johnson, Kimball, Reasons

Beutler England Clinic v. Mermentau Rice, Inc.

Opinion of the Court

In re Mermentau Rice Inc. et al.; — Defendant; Applying for Supervisory and/or Remedial Writs Office of Workers’ Compensation District 3, No. 03-01253; to the Court of Appeal, Third Circuit, No. WCW 07-00949.

Stay denied. Writ denied.

Concurring Opinion

KIMBALL, J.,

concurs and assigns reasons. While I question the Hearing Officer’s application of La. R.S. 23:1318 to grant Plaintiffs motion to quash the subpoenas issued in connection with the motion to recuse hearing upon which this writ has been filed, I concur in denial because Defendant did not seek timely review of that ruling in this Court.

JOHNSON, J., concurs for reasons assigned by Justice Kimball.
