Opinion of the Court

In re Newton, Ambrose; — Defendant; Applying For Supervisory and/or Remedial Writs, Parish of Orleans, Criminal District Court Div. C, No. 456-626; to the Court of Appeal, Fourth Circuit, No. 2009-K-1498.

Writ granted. The ruling of the trial court is reversed and the defendant is hereby ordered released on the $50,000 bond previously posted prior to conviction.

Concurring Opinion

KIMBALL, C.J.,

concurring, based upon the trial judge’s failure to provide adequate justification for increasing the defendant’s bond, notwithstanding this court’s request for such justification.

KNOLL, J., would deny the writ. GUIDRY, J., would deny the writ.
