State v. Perkins

Opinion of the Court

In re Perkins, Joseph; — Defendant; Applying For Supervisory and/or Remedial *590Writs, Parish of Orleans, Criminal District Court Div. E, No. 479-859; to the Court of Appeal, Fourth Circuit, No. 2010-K-0971.

Stay denied. Writ denied.

Concurring Opinion

KNOLL, J., concurs.

In my view, because of the posture of the trial, ruling on this matter would be premature. In the event the State attempts to introduce the statement, the trial court should rule on its admissibility under Lee v. Illinois, 476 U.S. 530, 106 S.Ct. 2056, 90 L.Ed.2d 514 (1986).
