In re State of Louisiana; — Plaintiff; Applying For Supervisory and/or Remedial Writs, Parish of Orleans, Criminal District Court Div. A, No. 520314; to the Court of Appeal, Fourth Circuit, No. 2014-K-0994.

Concurring Opinion

CLARK, J.,

votes to grant with order, instructing the trial court to comply with La.Crim.Code art. 334.3. He finds the statute specifically instructs that persons charged with distribution who do not voluntarily surrender cannot be readmitted to bail. This is a specific statute that governs over the general requirement of holding a contradictory hearing to determine if the defendant is a flight risk.
