| Writ denied m part; granted m part. The judgment of the court of appeal is affirmed in all respects, except as to the award of damages for the filing of a frivolous appeal. The sanction imposed by the court of appeal is hereby reversed.

concurring in part and dissenting in part,
Ixl concur in the court’s decision insofar as it affirms the dismissal of the action objecting to Mr. Perilloux’s candidacy. I respectfully dissent, however, - from the court’s decision to reverse the award of sanctions without first affording the prevailing party an opportunity to respond.
