Opinion of the Court

*785I find the trial court's ruling was an abuse of discretion and in direct contravention of La. C.C.P. art. 966 and La. Dist. Ct. Rules 9.8 and 9.9. Therefore, I would grant this writ application and remand the matter to the trial court to rule on the motion for summary judgment based on all pleadings, affidavits, depositions, answers to interrogatories, and admissions on file as of September 20, 2017. See Newsome v. Homer Memorial Medical Center , 10-0564 (La. 4/9/10), 32 So.3d 800.
