Mansfield v. Doughty

Massachusetts Supreme Judicial Court
Mansfield v. Doughty, 3 Mass. 398 (Mass. 1807)

Mansfield v. Doughty

Opinion of the Court

Sundry errors were assigned, the first of which was that the demand annexed to the original submission was not subscribed by the person making it. And for this the Court reversed the judg *350ment, observing that this, being a special jurisdiction, m derogation of the common law, must be strictly pursued (1).

Prescott, for the plaintiff in error. Putnam, for the defendant in error.
