Opinion of the Court
The object of this writ of error is to reverse a judgment rendered in this court, at October term 1838, in favor of the defendant in error against the plaintiff in error. By the record it appears that the original plaintiff sued on a promissory note ; that it was found by the jury that certain usurious interest had been reserved or taken, and a corresponding deduction, by way of forfeiture, was made from the amount of the note ; and that the plaintiff had judgment for the balance, conformably to the Rev. Sts. c. 35, § 2. It further appears, that the plaintiff had judgment for his costs, and the defendant also for his costs. The error assigned and now insisted on is, that judgment was given for the plaintiff for costs. The provision
